Memorandum of Understanding Between the U.S. Army Corps of Engineers and the Association of State Floodplain Managers
This memorandum of understanding between USACE and the Association of State Floodplain Managers (ASFPM) establishes a shared set of partnership principles to guide them in recognizing the public value of the Nation's floodplains and water resources and their contribution to public safety and the national economic, national security, and environmental quality. To this end, USACE and ASFPM will strive to support robust investments in critical water resources infrastructure and related activities; foster cooperation, ongoing communication, data development, and sharing among all stakeholders of all levels and agencies of government; collaborate on education and training of floodplain management professionals through the Certified Floodplain Manager program and other educational opportunities; and support continued research, development, adoption, and educational outreach associated with nonstructural flood risk management standards, project, and initiatives.

Memorandum of Agreement Between the U.S. Army Corps of Engineers and the Natural Resources Conservation Service

Memorandum of Understanding Regarding Interagency Coordination and Collaboration for the Protection of Tribal Treaty Rights and Reserved Rights
This interagency memorandum of understanding affirms the commitment of the signatory parties to protecting tribal treaty rights, reserved rights, and similar tribal rights to natural and cultural resources. The signatories intend to demonstrate that commitment through early consideration of treaty and reserved rights in agency decision-making and regulatory processes. They also intend to enhance interagency coordination and collaboration to protect such treaty and reserved rights and to fully implement federal government treaty obligations. Tribes, Alaskan Natives, and Native Hawaiians that do not have formal treaties may also have rights that should be considered in federal decision-making and regulatory processes addressed under the framework of this MOU.

This Memorandum of Agreement between the Federal Emergency Management Agency (FEMA) and the Department of the Army underscores the policy of both agencies to facilitate the use of non-structural approaches to reducing flood damages where practicable, and that the construction of levees on Hazard Mitigation Grant Program (HMGP) lands is incompatible with open space uses and, therefore, will not be recommended for implementation. The restriction on levee construction generally does not apply to structures designed specifically for ecosystem preservation, restoration, or enhancement. Structures for these purposes are deemed consistent with the open space uses requirement of the HMGP.
